March 18, 2004 Post-Secondary Learning Act Proclaimed; Regulations established

By Order-in-Council, the new Post-Secondary Learning Act was proclaimed in force on March 18, 2004 – with the exception of section 61(2)(b) on tuition fees, which comes into force on September 1, 2004. Six Regulations to accompany the Act were also established by Order-in-Council.

See a short overview of the changes introduced by the new legislation (doc.). There are no surprises here – this is just Bill 43 with amendments as passed and given Royal Assent last December – but it only has the force of law now that, finally, it has been proclaimed.

View the full text of the three Regulations which are of most relevance to us – those concerning Approval of Programs of Study (doc.); Model Provisions (doc.); and Public Post-Secondary Institutions Tuition Fees (doc.). The first of these concerns the Campus Alberta Quality Council, but, as you can see, some key questions remain to be worked out; under section 7 of the Regulation, for example, the Council (which has yet to be named) will itself establish the minimum organizational conditions required of institution seeking approval of a degree program, and will establish the standards of quality by which a proposed degree program is judged.
